2. Scope of Application

These Terms and Conditions apply to all contracts for the purchase of artworks concluded between SophStudioWorks and its customers via the online shop or by direct written agreement.
They apply exclusively. Deviating terms of the customer do not apply unless expressly agreed in writing.

3. Subject of the Contract

The subject of the contract is the sale of original artworks and, where explicitly stated, made-to-order or commissioned works. Each artwork is described individually on the product page.

4. Conclusion of Contract

The contract is concluded when the customer completes the order process in the online shop and receives an order confirmation by email.
For purchases agreed by email, the contract is concluded upon written confirmation by SophStudioWorks.

5. Prices and Taxes

All prices shown are final prices in euros.
In accordance with §19 UStG (German Small Business Regulation), no VAT is charged or shown unless otherwise stated.

Shipping costs are shown separately during checkout and are borne by the customer.

6. Payment

Payment is due immediately upon conclusion of the contract.
The available payment methods are displayed during checkout.
Partial payments are not accepted unless expressly agreed in writing.

7. Delivery and Shipping

Artworks are shipped after payment has been received in full.
Estimated delivery times are provided on the website or during checkout and are non-binding.

All shipments are securely packaged and insured.
If delivery is delayed, the customer will be informed without undue delay.

For international deliveries, additional customs duties or import taxes may apply and are borne by the customer.

8. Transfer of Risk

For consumers, the risk of accidental loss or deterioration of the artwork passes to the customer upon delivery of the artwork.

9. Retention of Title

The artwork remains the property of SophStudioWorks until full payment has been received.

10. Copyright and Use of the Artwork

All copyrights and reproduction rights remain with the artist unless expressly agreed otherwise in writing.

The purchase of an artwork does not grant the customer any rights to reproduce, distribute, or commercially use the artwork.
Resale of the original artwork is permitted.

11. Right of Withdrawal

Consumers have a statutory right of withdrawal.
Details can be found in the Refund Policy / Right of Withdrawal available on this website.

12. Warranty and Liability

The statutory warranty rights apply.

SophStudioWorks is liable without limitation for damages resulting from intent or gross negligence, as well as for injury to life, body, or health.

In cases of slight negligence, liability is limited to foreseeable damages typical for this type of contract.

13. Data Protection

Information on the processing of personal data can be found in the Privacy Policy available on this website.

14. Applicable Law and Jurisdiction

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

For consumers, this choice of law applies only insofar as mandatory consumer protection provisions of the country of residence are not deprived.

SophStudioWorks is not obliged and does not participate in dispute resolution proceedings before a consumer arbitration board.
